1. Introduction

These Terms and Conditions ("Agreement") govern the provision of courier services by Hyzr Transportations and Services Private Limited ("Hyzr", "we", "us", or "our") to the customer ("you" or "your"). By using our services, you agree to comply with these terms. If you do not agree to these terms, you should refrain from using our services.

2. Service Availability

Hyzr provides parcel and document delivery services to various locations as specified on our website or through direct communication. Our services are available within the operational regions and may be subject to change without prior notice.

3. Consignment Acceptance

We will accept consignments only after verification of the details provided by you. We reserve the right to reject any consignment that does not comply with our guidelines or policies. You must ensure the goods are packaged appropriately and meet safety and legal requirements.

4. Prohibited and Dangerous Goods

We do not accept consignments containing prohibited or dangerous goods, including, but not limited to:

Explosives, flammable, or combustible materials

Toxic substances, biological or infectious materials

Firearms, ammunition, or illegal goods

Stolen property or counterfeit items

Hazardous waste

5. Dangerous Goods and Special Services

For the transportation of dangerous goods, you must declare such items prior to shipment, and these will only be accepted under specific conditions. Dangerous goods are subject to a surcharge and must comply with the applicable regulations. Acceptance of dangerous goods is contingent upon your status as an approved customer.

6. Delivery Times

Estimated delivery times are provided for your convenience but are not guaranteed. Delays may occur due to weather, traffic, or other unforeseen circumstances. We do not accept liability for any damages or losses incurred due to delays.

7. Insurance and Liability

We recommend you purchase appropriate insurance coverage for your consignments. Hyzr is not responsible for loss or damage to items unless caused by our negligence. Our liability is limited to the value of the goods as declared by you and is subject to maximum limits set by applicable law.

8. Customer's Declaration

You must provide accurate information regarding the nature, content, and value of the goods being shipped. The goods are shipped "said to contain" based on the declaration provided by you. We do not assume responsibility for the correctness of your description. You agree to indemnify and hold us harmless from any claims, losses, or legal actions arising from incorrect declarations.

9. Payment

All fees for services rendered by Hyzr are due at the time of shipment or as otherwise agreed upon. Payment can be made via the payment options available on our website or directly to our designated accounts. Any unpaid balances will be subject to interest and penalties as determined by applicable laws.

10. Cancellation and Refund Policy

You may cancel a shipment within a specified period before dispatch, subject to a cancellation fee. Refunds will be processed according to our Refund Policy and are subject to the nature of the cancellation.

11. Customs and Import Regulations

For international shipments, you are responsible for ensuring that your goods comply with all customs and import regulations in the destination country. Hyzr will not be held responsible for any delays or issues related to customs clearance.

12. Privacy and Data Protection

We respect your privacy and handle all personal data in accordance with our Privacy Policy. By using our services, you consent to the collection, processing, and use of your personal data as outlined in the policy.

13. Force Majeure

Hyzr shall not be liable for any failure or delay in performing its obligations if such failure or delay is caused by an event beyond our control, including but not limited to natural disasters, strikes, government actions, or transportation failures.

14. Dispute Resolution

Any disputes or claims arising out of or in connection with these Terms and Conditions shall be resolved through negotiation between the parties. If a resolution cannot be reached, the matter shall be submitted to the jurisdiction of the courts in the state where Hyzr is registered.

15. Amendments to Terms

Hyzr reserves the right to modify these Terms and Conditions at any time. Any changes will be posted on our website and will apply to all services provided after the update.

Responsibility for Items

1.1. Absolute Responsibility: Delivery personnel are fully responsible for the safety and security of parcels in their possession. Any negligence leading to loss or theft will result in strict disciplinary action, including termination and legal consequences.
1.2. Mandatory Inspection: Delivery personnel must check parcel condition upon pickup and delivery. Any damage or irregularity must be reported immediately before proceeding.
1.3. Secure Handling: Parcels must never be left unattended under any circumstances. If a parcel is left unsecured, the delivery personnel will be held directly accountable.

2. Loss and Theft

2.1. Immediate Reporting: Any loss or theft must be reported to the company within one hour of discovery. Failure to report will result in severe penalties, including possible salary deduction or job termination.
2.2. Evidence Submission: The delivery personnel must provide a written explanation along with any available evidence (CCTV footage, delivery logs, witness statements, police reports, etc.).
2.3. Internal Investigation: The company will conduct a strict investigation. If found guilty of misconduct or negligence, the personnel will be liable for full compensation of the lost item and may face legal action.
2.4. Police Involvement: In case of theft, the company will immediately file a police complaint, and the delivery personnel may be required to cooperate in the investigation.

3. Compensation and Financial Liability

3.1. Zero Compensation from Company: Hyzr Transportations and Services Pvt Ltd will not be responsible for compensating the customer unless the loss was due to a company process failure.
3.2. Employee Liability: If a delivery person is found responsible for the loss, they must pay for the full value of the lost item. The company reserves the right to deduct the amount from their salary or legal settlement.
3.3. Customer Complaints: Any customer complaints regarding missing or stolen parcels will be strictly reviewed, and repeated complaints against delivery personnel will result in immediate termination.

4. Prevention and Security Protocols

4.1. Mandatory Proof of Delivery: Delivery personnel must collect the recipient’s signature or OTP verification for every parcel.
4.2. No Unauthorized Handling: Only the assigned delivery personnel should handle the parcel. Sharing or transferring the parcel to another person without permission is strictly prohibited and will result in termination.
4.3. High-Risk Area Protocol: In high-risk areas, additional security measures such as real-time tracking updates and supervisor notification are mandatory.
4.4. Periodic Security Audits: Random parcel checks will be conducted, and any irregularity will result in disciplinary action.

5.Disciplinary Actions for Non-Compliance

  • First Offense: Salary deduction + Written warning.

  • Second Offense: Suspension + Full liability for lost items.

  • Third Offense: Immediate termination + Legal action (if applicable).
